RAINBOW WARRIOR SAILS TO CONFRONT US STAR WARS PROGRAM

Incoming US President George W. Bush is moving rapidly ahead with a "Star Wars" program to spend billions of dollars building a system to shoot down missiles with yet more missiles. If this program continues, it will violate the 1972 Anti-Ballistic Missile Treaty and may start a new nuclear arms race.

On 13 February, the Rainbow Warrior set sail for the remote Pacific atoll of Kwajalein in the Marshall Islands where, in March, we will confront the US military and oppose a scheduled Star Wars test.

We need your help. Please visit our Cyberactivist Centre at

http://cybercentre.greenpeace.org/t/s/983102960

and send letters to US Defense Secretary Donald Rumsfeld, UK Prime Minister Tony Blair and Danish Prime Minister Poul Nyrup Rasmussen.

FLOTILLA TO CONFRONT PLUTONIUM SHIPMENT IN TASMAN SEA

On 18 February, a flotilla of seven ships left Australia and New Zealand  for the Tasman Sea, to confront a shipment of weapons-usable plutonium fuel, or MOX (mixed oxide), bound for western Japan. The shipment started its 30,000 km voyage in Cherbourg, France on 19 January. Please help us oppose these plutonium shipments by sending a letter to your local Japanese embassy at

EMERGENCY ACTION NEEDED ON GENETIC ENGINEERING

Genetically-contaminated food from the United States is now spreading around the world and has been detected in countries as far apart as Canada and Japan.
The US Department of Agriculture (USDA) is accepting comments on genetically engineered food until Wednesday, 28 February. Please take a moment today and urge the USDA to support GE labelling by sending a letter from our Cyberactivist Centre at

HALT OIL DRILLING IN THE ARCTIC OCEAN

Giant oil company BP is invading the Arctic Ocean. It has not yet completed its Northstar development in the Beaufort Sea north of Alaska, but it has already applied to construct a twin of Northstar, the "Liberty" project. Global climate change is no where more obvious than in the Arctic Ocean, which has lost almost half its sea ice over the last forty years, threatening both local polar bear and walrus populations and throwing the world weather system into chaos.

Ironically, BP, a major producer of the largest cause of climate change, oil, is determined to drill beneath the rapidly shrinking Arctic ice pack. Please write to the US Minerals Management Service and oppose the Liberty project by going to:

GLOBAL WARMING: Earth to White House -- is anyone listening?
ONE FOR THE WOLVES: Supreme Court sides with endangered wildlife
GUSHING OVER OIL: BP Amoco just keeps on spilling
BUDGET BATTLES: White House eyes environmental programs
NATURE TRIVIA: What's the snowiest city in the United States?
EMERGENCY FUND: How you can help save the Arctic National Wildlife Refuge
RUNNING FOR ITS LIFE: Judge comes to Pronghorn's rescue

1. GLOBAL WARMING: Earth to White House . is anyone listening?

Rising world temperatures are already melting ice caps and raising sea   levels, and a new study warns that global warming could eventually lead to   droughts, floods, violent storms and the spread of cholera and malaria. This   week's report by the U.N.-sponsored Intergovernmental Panel on Climate   Change provides the strongest evidence yet that the burning of oil, coal and   gasoline has caused most of the global warming in the past 50 years. "We   hope this study serves as a wake-up call to the White House," Defenders   of Wildlife president Rodger Schlickeisen says. "President Bush is   opposed to U.S. ratification of the Kyoto Protocol, but the clock is ticking.   Every delay just makes the problem harder to solve and adds to the likelihood   of the coming catastrophes." The United States is one of several   industrialized nations that has yet to ratify the Kyoto Protocol, an agreement   first negotiated in 1997 requiring three dozen developed nations to reduce   greenhouse gases.

2. ONE FOR THE WOLVES: Supreme Court sides with endangered wildlife

At the urging of Defenders of Wildlife, the U.S. Supreme Court rejected a constitutional challenge to the Endangered Species Act. Without comment, the high court turned down an appeal by two North Carolina ranchers and two counties in the state.    Red Wolf

They contended that the Constitution doesn't authorize regulations prohibiting landowners from killing endangered red wolves that roam onto private property from a federal refuge. William Snape, vice president for law and litigation for Defenders of Wildlife, praised the Supreme Court for "upholding the strong national interest in protection of imperiled wildlife species." The ranchers were challenging a ruling won by Defenders of Wildlife in a case before a federal appeals court.

3. GUSHING OVER OIL: BP Amoco just keeps on spilling

Despite claims that oil drilling can be done in an environmentally friendly manner, BP Amoco dumped up to 9,700 gallons of oil onto Alaska's North Slope in two separate spills within a matter of hours this week. That didn't stop friends of Big Oil from beating the drum for drilling in the nearby Arctic National Wildlife Refuge. Even though oil accounts for only one percent of California's power generation, Interior Secretary Gale Norton said drilling in the pristine refuge would ensure "that elderly people in California are not having to worry about how to keep their homes warm." And Alaska Sen. Frank Murkowski, chairman of the Senate Energy and Natural Resources Committee, bragged that he's only three votes short of a Senate majority to open the refuge to oil development. Murkowski is introducing his bill as early as next week. What you can do: In only the first month of Defenders of Wildlife's on-line petition drive to protect the Arctic refuge, supporters have sent more than 650,000 e-mails and faxes to President Bush and Congress from our Web site SaveArcticRefuge.org   We've created a special animated video to help our campaign. To view the animation, click here. To join our growing on-line petition drive, click here: http://www.savearcticrefuge.org -- and don't forget to forward the petition to your friends.

4. BUDGET BATTLES: White House eyes environmental programs

The word in Washington is that the White House is targeting some   environmental programs for big budget cuts of up to 20 percent. Reportedly on   the chopping block: Programs to manage and protect vast tracts of public   wilderness set aside by former President Clinton as national monuments.   Interior Secretary Norton already is publicly saying she wants to allow   commercial mining on those public lands. "If our opponents can't kill   conservation programs openly, they will try to do it quietly through funding   cuts," Defenders president Rodger Schlickeisen says. "At his news   conference this week, President Bush promised a 'responsible and fair budget   that reflects the nation's priorities,' and we're going to hold him to   his word. It's clearly a national priority to preserve our last remaining   wildernesses."

5. NATURE TRIVIA: What's the snowiest city in the United States?

A. Caribou, Maine
B. Rugby, North Dakota
C. Juneau, Alaska
D. Oswego, New York

Scroll to the bottom of DENlines for the answer.

6. EMERGENCY FUND: How you can help save the lives of wildlife in the Arctic National Wildlife Refuge

Special interests led by Big Oil are spending millions of dollars from record   profits to persuade your senators and representative to open America's   greatest wildlife sanctuary to drilling. This refuge is home to arctic wolves,   polar bears, caribou, and millions of migratory birds. Scientists warn that   drilling and the likely pollution will harm wildlife and the habitat they need   to survive.

Please make a special tax-deductible contribution to help us fight Big Oil   on Capitol Hill. For your contribution of $50 or more, we'll thank you with   a plush stuffed wolf.       Donate Now!

  7. RUNNING FOR ITS LIFE: Judge comes to Pronghorn's rescue

Clocking speeds of more than 50 mph, the critically endangered Sonoran   Pronghorn is the fastest terrestrial mammal on the continent. But even the   Pronghorn can't outrun bombs. Ruling in favor of a lawsuit brought by   Defenders of Wildlife, a federal judge has ordered seven federal agencies to   examine the cumulative impact of bombing, troop maneuvers, low-level flights   and other military training exercises on the Pronghorn. In southwest Arizona's   Sonoran Desert, the Pronghorn must cope with myriad activities by military   units that train on the Barry M. Goldwater Range. Only 120 of the vanishing   animals still remain in the United States. The judge found this week that none   of the federal agencies considered whether, taken together, all their   activities may cause the Sonoran Pronghorn to become extinct. The Endangered   Species Act require this analysis, and under the court's ruling, all seven   agencies must undertake it.

Trivia answer: C, Juneau, Alaska. The nation's snowiest city gets  an astonishing 105.3 inches of snow every year . that's nearly nine feet!   Wildlife that call Juneau home don't mind all that snow, particularly brown   and black bears and mountain goats. Other snow-bound wildlife there include   bald eagles, Sitka black-tailed deer, lynx, wolves, wolverines, red foxes and  coyotes.

from League of Conservation Voters February 26, 2001

===================================
LCV's Weekly Congressional Update
Week of February 26th, 2001
===================================

The League of Conservation Voters (LCV) continues to monitor Congressional
activity and hold Members accountable for their action on important
environmental issues. See the information below for a concise look at what
happened in Congress last week and what we anticipate for the coming week.

===================================
SUMMARY
===================================

National energy policy takes center stage;

Bush will speak to a joint session of Congress Tuesday night to outline
his economic plan - budget cuts for environmental protections expected;

Auto makers drop opposition to higher CAFE standards;

Green Scissors 2001 report released.

===================================
ON THE FLOOR THIS WEEK
===================================

**SENATE**

**After a number of delays, Senator Murkowski (R-AK) introduced his energy
bill this week. A draft of his legislation has already come under fire
from the environmental community primarily over a provision to open up the
coastal plain of the Arctic National Wildlife Refuge to oil and gas
drilling. However, there are a number of harmful provisions in the draft
bill that have not received as much attention in the media. For example,
Murkowski's bill would increase taxpayer subsidies to promote the
development of "clean coal", weaken clean air standards for power plants
and restrict the U.S. Bureau of Land Management's (BLM) ability to issue
permits for dams and hydro-projects on our public lands. As a result, the
BLM's capacity to ensure protections for fish, wildlife and water quality
would be hampered.

Murkowski's energy proposal focuses primarily on the production side of
the equation and not on decreasing demand for energy or increasing the use
of renewables. The energy problems of the new millennium cannot be solved
with 19th century solutions.
Last week, Senator John Kerry (D-MA) pledged to filibuster any energy bill
that included drilling in the Arctic National Wildlife Refuge. To learn
more about the bill and to read polling on the issue click www.lcv.org.

**HOUSE**

**The Environment and Energy Daily reports that environmental programs
could face large cuts under President Bush's first budget. Although
detailed agency breakdowns will not be available until April, speculation
over which departments will get hit is growing. According to press
reports, the Interior Department could see a five to seven percent cut in
funding from last year. Funding for national monuments and firefighting
preparedness may be likely targets. Endangered species protection programs
are expected to receive major reductions as well.
In the Department of Energy, programs dealing with energy efficiency and
nuclear waste cleanup could see as much as a $1 billion cut. Specifics on
the EPA and other programs are not available. However, the nation's
primary environmental enforcement agency is expected to receive some of
the largest budget reductions.
President Bush will address a joint session of Congress on Tuesday night
to outline his economic program. To learn more click
http://www.eenews.net/EEDaily.htm (subscription required)

**In response to the growing outrage over proposals to drill in the Arctic
Refuge, a bipartisan group of House lawmakers are set to introduce
legislation this week to designate the wildlife refuge as a "wilderness"
area, which would ban all drilling.
The press conference will be held by Reps. Markey (D-MA) and Johnson
(R-CT) on Wednesday, February 28th. The bill already has 107 Republican
and Democratic co-sponsors:

Rep. Edward Markey - lead sponsor
Rep. Nancy Johnson - lead sponsor

IN COMMITTEE THIS WEEK
===================================

**SENATE**

**The Finance Committee will hold a hearing on globalization and the
impacts of U.S. trade policy this Tuesday. International trade will be an
early challenge for the new administration with the possible authorization
of fast track negotiating authority and the growing demand for stronger
labor and environmental standards in trade agreements.

Sen. Max Baucus (D-MT), the ranking democrat on the Finance Committee, has
come out in front of the debate, stating that he will block the
administration from receiving fast track authority so long as progress is
not made to include labor and environmental provisions.

The hearing will take place on Tuesday at 10:00am.

**The Senate Environment and Public Works committee will hold hearings on
Sen. Chafee's brownfields legislation. The Brownfields Revitalization and
Environmental Restoration Act (S. 350) has received bipartisan support in
committee and is considered to have a good chance at passage this year.
One sticking point, however, will be the role that the EPA will play in
brownfields redevelopment after the areas are considered clean by state
agencies. Brownfields are contaminated industrial sites that are not
sufficiently polluted to qualify for cleanup funds under the federal
Superfund program. Developers have been hesitant to invest in these sites
due to the threat of future lawsuits over low-level contamination.
Chafee's bill would provide liability exemptions, or "finality", by
placing some limits on the EPA's enforcement actions.

The full committee hearing will take place on Wednesday, Feb. 28th, at
9:30am. Witnesses will include the new EPA administrator Christine Todd
Whitman.

**The Senate Agriculture Committee will hold hearings on a new farm bill.
Farm bill provisions such as the Conservation Reserve Program, which pays
farmers not to use environmentally sensitive areas, have had a strong
positive impact on environmental protection in farm states.

The hearings will take place on Wednesday, Feb 28th and Thursday, March
1st at 9:00am.

**HOUSE**

**The Water Resources and Environment Subcommittee will hold hearings on
the EPA's controversial new total maximum daily load (TMDL) rule.
According to the Clean Water Network, "a TMDL (Total Maximum Daily Load)
is the total amount of a pollutant that a body of water can handle from
all sources. Once the TMDL is calculated, it is used as a basis for
putting limits on the amount that pollutant that can be discharged into
the river, lake or stream from all sources, while still allowing that body
of water to meet its designated water quality standard. For more
information click http://www.cwn.org .

The hearing will take place on Wednesday, Feb 28th at 10:00am. Witnesses
will include Governors John Hoeven (R) of North Dakota and John Kitzhaber
(D) of Oregon.

**The Subcommittee on Energy and Air Quality chaired by Rep. Joe Barton
(TX-06) will hold a hearing entitled "National Energy Policy" on
Wednesday, February 28th at 1:00pm. The first day will focus on natural
gas supply issues.

**The Budget Committee will hold hearings on the President's FY2002 budget
proposal (see above). Specific agency breakdowns are not expected until
April.

The hearings will take place on Thursday at 10:00am and 3:00pm.

NEWS FLASH!!

**An annual report documenting wasteful government spending on
environmentally destructive programs was released late last week.
"The Green Scissors 2001 report, endorsed by more than 24 organizations,
highlights programs that taxpayer, environmental and consumer
organizations agree should be cut. Green Scissors 2001 targets ten 'Choice
Cuts' which are particularly vulnerable to congressional actions as well
as nine new programs that hurt the environment and waste taxpayer dollars.
The full list of recommended cuts ranges from money losing timber sales to
coal industry subsidies."

"Green Scissors" is published jointly by Taxpayers for Common Sense, U.S.
PIRG and Friends of the Earth. To learn more or to read the report click
www.greenscissors.org.

**Last week, the auto industry dropped its long-time opposition to raising
the corporate average fuel economy (CAFÉ) standards for new cars, trucks
and SUVs and announced its support for an alternative fuel vehicle tax
credit. Raising the mileage per gallon for new vehicles is viewed by
environmentalists and a growing majority in Congress as one of the best
methods for reducing foreign oil dependency while protecting the
environment and saving the consumer money at the pump.
For the past several years, this issue has been the subject of an annual
appropriations battle over a rider that placed a freeze on funding
research on or raising miles per gallon standards for the corporate
average fuel economy. To learn more click

from League of Conservation Voters February 26, 2001

WASHINGTON (February 26, 2001) - Today the League of Conservation Voters
(LCV) declared U.S. Sen. Frank Murkowski. s (R-Alaska) National Energy
Security Act of 2001 "dead on arrival" since it includes a provision to
open the Arctic National Wildlife Refuge to oil production and fails to
seriously address domestic demand. Opening the Arctic Refuge to the
environmentally devastating impacts of oil drilling is opposed by a
growing, bipartisan group of Senators, including Sen. Bob Smith (R-N.H.),
chairman of the Senate Energy and Public Works Committee, and Sen. John
Kerry (D-Mass.), who has pledged to filibuster any bill that includes an
Arctic drilling provision. A recent bipartisan poll conducted by the
League of Conservation Voters Education Fund showed that two-thirds (66
percent) of American voters support permanently protecting the Arctic
Refuge from oil drilling.

DEN Alert:
Keep a National Forest Safe from Off-Road Vehicle Impacts

The U.S. Forest Service (USFS) and an off-road vehicle (ORV) working
group has released their ill conceived plan for motorized access in
Florida's Ocala National Forest. The plan fails to protect ecologically-
sensitive wildlife habitat from damage by ORVs. USFS has made no
serious attempt to protect or address threats ORVs pose to natural
resources and wildlife. Defenders of Wildlife is concerned that
decisions are being made and positions set among many of the off-
road vehicle representatives and forest service staff without the
best scientific information or consideration of devastating ecological
impacts of ORVs.

It's critical that the Forest Service and ORV users take into
account the variety of detrimental impacts ORVs have to the Ocala
National Forest's landscape, plants and animals.  Those impacts
include: wildlife disturbance and displacement and wildlife habitat
and wetlands destruction. Defenders of Wildlife needs strong public
support to prevent the opening of access roads to ORVs that would
fragment, destroy and disrupt sensitive wildlife habitat in
restricted areas of the Ocala National Forest.

WHAT YOU CAN DO:

Send a free e-mail to the supervisor of Florida's national forests
and tell her that the ORV access plan does not go far enough to
protect wildlife and their habitat from off-road vehicles.
Comments are due by MARCH 20, so send your message today. Thanks
for doing your part to protect our nation's forests!

INSTRUCTIONS TO RESPOND VIA THE WEB:

If you have access to the web, simply click on the link below which
will take you to the DEN Action Center web site:

                        http://www.denaction.org

If you don't have access to the Internet, please e-mail your letter
to: mkearny@fs.fed.us or mail it to: Marsha Kearny, Forest Supervisor,
National Forests of Florida, 325 John Knox Road, Suite F-100,
Tallahassee, FL, 32303-9300.

SAMPLE LETTER:

Dear Ms. Kearney:

The access plan for restricted areas in the Ocala National Forest
proposed by the Access Designation working group is fundamentally
flawed in light of the absence of sound scientific and ecological
information and should be modified to protect natural resources and
sensitive species.

The plan justifies a network of intertwined, illegal ghost trails
and woods roads created from years of lax Forest Service law
enforcement of restricted areas on the Ocala. The plan was created
without data on the current level of ORV use in comparison to other
recreational users and without the current level of ORV use of
restricted areas. The Forest Service has not analyzed what ORV
impacts will result from the proposed plan. Off-road vehicle (ORV)
impacts were not studied before proposing to open restricted areas
to ORV use.

I emphasize the following points:

*    Do not approve the access designation process plan because it
justifies a damaging network of illegal ghost trails and woods roads
created from years of lax Forest Service enforcement of restricted
areas on the Ocala forest.

*    Protect restricted areas by closing redundant routes to the
same destination, dead-end roads and loops.

*    Protect wetlands, red-cockaded woodpecker clusters, wood stork
colonies and other habitats with threatened and endangered species
by closing woods roads in and around such areas.

*    Reject the portion of designated ORV trail and open numbered
woods road system in the Paisley Woods in the Seminole District of
the Ocala, that concentrate ORV use in the core of the most vibrant
red-cockaded woodpecker clusters, their recovery and foraging areas.

*    Do not establish an ORV staging area in a USFWS designated
woodpecker recovery area. The staging area combined with the "open"
woods road system could cause harassment and displacement of red-
cockaded woodpeckers which is prohibited under the Endangered
Species Act. The Forest Service must also study red-cockaded
woodpeckers' displacement, harassment and stresses by ORVs before
enhancing access.

*    Before enhancing access to restricted areas, create an ORV
management and education plan that will establish rules for ORV
users and adequate law enforcement.

Thank you for your consideration of my thoughts regarding this
issue.

Sincerely,

1.  Help Free Mexican Environmentalists

Earlier this month, Mexican President Vicente Fox ordered the President's
lawyer to review the case of Rodolfo Montiel and Teodoro Cabrera to, in the
President's words, "find out the truth."  The human rights of these
activists were violated when they were arrested and tortured by soldiers of
the Mexican army.  We must hold President Fox to his promises to work
together with the defense lawyers to find a legal resolution to this case
and to bring those responsible to justice.

Ask the President to direct his Attorney General to recommend that the
amparo  (an appeal that is filed to challenge the act of an authority that
violated an individual's Constitutional guarantees) be granted.  This
action by the Attorney General is likely to result in the freedom of
Montiel and Cabrera because the defense and the prosecution would both be
recommending that the appeal on behalf of the two activists be granted.

2. Take Action To Protect America's Wild Forest Heritage

Write a letter to the editor of your Representative and Senators.  Below is
an example of how to tailor your letter to include examples from your area
or
local forest. Send your letter to your Member of Congress at the following
address:

          The Honorable Rep.____________
          U.S. House of Representatives
          Washington, D.C.  20515

          The Honorable Sen. ___________
          U.S. Senate
          Washington, D.C.  20510

Our National Forests we established over one hundred years ago
for all Americans to enjoy. These forests provided clean drinking
water for communities, outstanding recreation for families, and
excellent habitat for fish and wildlife. They have also given us
          tremendous scientific and educational benefits.
Unfortunately, for the past 50 years, the
Forest Service has spent billions of taxpayer dollars subsidizing
the logging of public lands and building roads for logging
          companies.

Clearly it is time to end the Forest Service commercial logging
program. Please do all that you can to protect our National
Forests from logging, for our families, for our future.

-------------------------------------------------------------------------
3. Tell the EPA to Regulate Global Warming Emissions as Pollutants

The EPA is requesting comments on a petition to regulate the global warming
pollution that spews out the tailpipes of cars. The petition, submitted by
a coalition of environmental groups, requests that the agency use a
provision of the Clean Air Act to regulate the emissions of carbon dioxide,
methane, nitrous oxide and hydrofluorocarbons from new cars, light trucks
and other engines. The petition asserts that greenhouse gases contribute to
global warming and should be regulated as pollutants that can cause
significant damage to the environment and public health.

Public comments are due to EPA by May 23, 2001.

Please e-mail comments to: A-and-R-Docket@epa.gov

For more information, go to:
http://www.epa.gov/fedrgstr/EPA-AIR/2001/January/Day-23/a1979.htm

-------------------------------------------------------------------------
4. Say No to Oil and Gas Development in Bridger-Teton National Forest

The Bridger-Teton National Forest, bordering Yellowstone National Park in
northwest Wyoming, is world famous for its blue ribbon trout streams,
winding through lush valleys complete with vast herds of elk. But the oil
and gas industry is fighting to open up nearly 370,000 acres -- an area
larger than neighboring Grand Teton National Park -- to oil and gas
development. Drill rigs, accompanied by a maze of roads and power lines,
already fracture many of the last best places in the Greater Yellowstone
area.

The Bridger-Teton National Forest recently proposed to put this land off
limits to oil and gas industrialization. The public overwhelmingly supports
this proposal, known as the "No Lease" alternative in the draft
environmental impact statement for oil and gas development. In fact, 98
percent of the more than 2,500 comments received supported the "No Lease"
alternative. Big oil is working to reverse this proposal. Only through an
emphatic show of public support for the Forest Service proposal will the
"No Lease" decision hold.

This decision will set a precedent for the future management of our
national forests: Will our public lands be managed mainly for
industrial-scale resource extraction and production? Or are some places
simply too important because of their wildlife, clean water and recreation
opportunities?

Tell the Forest Service to continue its efforts to protect the
Bridger-Teton National Forest. Say you support the "No Lease" alternative.

For a sample letter, see:
www.sierraclub.org/takeaction/wildlands/

-------------------------------------------------------------------------
5. Fight for Responsible Trade The North American Free Trade Agreement was
supposed to relax trade restrictions between Canada, Mexico and the United
States. But some of those alleged trade restrictions are hard-won
environmental laws.

But NAFTA contains dangerous provisions (similar to those in Newt
Gingrich's Contract with America) that allow corporations to sue
governments if environmental laws get in the way of profits. Already, a
Canadian chemical company has used these NAFTA provisions to sue the United
States for $1 billion because California banned a carcinogenic gasoline
additive that is poisoning the state's drinking water.

The Bush administration now wants to expand these dangerous provisions
though a new trade pact, the Free Trade Area of the Americas (FTAA)
agreement, covering the entire Western Hemisphere.

The FTAA has been negotiated in total secrecy. Please write to your
senators and representatives and urge the Bush administration to "release
the text" of the FTAA so the public can understand its terms.

Write your senators at: U.S. Senate, Washington, DC 20515.
Write your representative at: U.S. House of Representatives, Washington, DC
20510.

-------------------------------------------------------------------------
6. Urge Bush to Reinstate Support for International Family Planning Only
two days after his inaugural address, President Bush dealt a blow to
international family planning programs by reinstating the global gag rule.
The global gag rule bars international family planning organizations that
receive a single dollar of U.S. funds from using their own money to talk
about abortion with their patients, provide abortion services, or lobby to
change abortion laws in their countries.

Tell President Bush you disagree and ask him to support these programs in
the future. For more information, go to Global Population and the
Environment:

SUPREME COURT CLEARS EPA TO REGULATE CLEANER AIR

By Cat Lazaroff

WASHINGTON, DC, February 27, 2001 (ENS) - In a major defeat for
polluting industries, the U.S. Supreme Court ruled unanimously today
that the federal government need not consider the financial costs of
meeting clean air standards when creating new regulations. The court
rejected industry arguments that the health benefits of cleaner air must
be balanced against the costs of compliance.

SC-ACTION Vol. III, # 22
DEFENDING THE ENVIRONMENTAL AGENDA
February  26, 2001

Quote of the Day

"Senator Murkowski's bill is a give-away for fossil fuel producers.
All it leaves for renewable and clean energy are table scraps."
--Ann Mesnikoff, Sierra Club Washington Representative

Table of Contents:

1. FEATURED ITEM:Urge your Senator to Oppose the Murkowski Energy Bill

2. Tell the EPA to Regulate Global Warming Emissions as Pollutants

*************************************************************************

1. FEATURED ITEM: Urge your Senator to Oppose the Murkowski Energy Bill

The Sierra Club is calling on Congress to reject the energy bill Sen. Frank
Murkowski (R-Alaska) introduced today. The legislation fails to solve
America's energy problems. Instead of setting America on the path of a
sustainable, clean and affordable energy future, the bill is a polluter
give-away. The Murkowski bill masks itself as a response to both
California's energy shortage and the nation's long-term energy needs. In
reality, the bill increases dependence on fossil fuels, worsens air
quality, exacerbates global warming and destroys national treasures such as
those found in the Arctic National Wildlife Refuge and western lands--while
failing to solve our nation's energy problems.

To send an e-mail to your Senator, go to the Take Action part of our
website by clicking below:

Public comments are due to the EPA by May 23, 2001.

from Global Response February 28, 2001

Dear Members of Global Response's "Quick Response Network:"

In our 10-year history, Global Response has issued more Action alerts
against Shell Oil Company than any other multinational corporation.  In the
past year alone, two out of six of our hardcopy Action alerts targeted
Shell for its illegal oil explorations in the protected mangrove forests of
Bangladesh and in Kirthar National Park in Pakistan.  Protests against
Shell are ongoing in dozens of countries worldwide.

How is it possible that Shell is being honored with an Environmental Award?

Please send a letter of protest to the World Environment Center for
honoring Shell with its 2001 Gold Medal for International Corporate
Environmental Achievement.  Thanks to the World Rainforest Movement for
circulating the following Action Alert:

                       WRM ACTION alerts
                              FEBRUARY 2001

Letters of protest against WEC's award to Shell

Oil companies are worldwide known for the negative environmental
impact they produce both at the local and the global levels. While in the places where oil
prospection and exploitation is performed, environmental destruction and social
disruption is the rule, at the global level the burning of fossil fuels is one of the main causes
of global warming.

To face increasing criticisms, Shell recently launched a campaign
--"Profits and Principles. Is there a choice?"-- in influential Northern press media,
trying to portray itself as environmentally sound and a defender of human rights.

The campaign seems to have born fruit: Shell will receive next March
the 2001 Gold Medal for International Corporate Environmental Achievement awarded by
the World Environment Center (WEC).

We have received the following from the Ogoni people:

"This would be laughable if it were not so sad and painful, bearing in
mind Shell's well publicised poor record on environmental responsibility in Ogoniland
and the Niger Delta of Nigeria. The world is not in doubt about Shell's terrible
activities in Ogoniland, which resulted to its complicity in the hanging of environmental, and human
rights activist, Ken Saro Wiwa and the eight other Ogoni activists. Shell's exploration
activities in Ogoniland caused the devastation of the environment, pollution of the rivers &
streams as well as destruction of farmlands depriving the people of their source of
livelihood. The continuing suffering of the people from the
indignity of living with broken pipelines, daily inhalation of
poisonous gas flares, incessant oil spills / fires and dealing with the prospect of owning a wasteland
cannot be ignored or forgotten.

"Shell is guilty of abuse of the Ogoni people and their environment
and this has been confirmed by the United Nations' fact-finding mission to Ogoniland,
which among others recommended that Shell institute an environmental audit of the land.
Shell was asked to clean up Ogoni environment, re-route and bury its surface pipelines,
pay compensation to the people and respect their human rights and as well as ensure that
any further oil exploration activities is based on agreement with the people. There
has been no honest response from Shell on these matters. Instead it continues to ignore
these recommendations and tries to force its way back into the community,
through corrupt means thereby causing further conflict amongst the people.

"Sadly, World Environment Center (WEC) an organisation founded by the
United Nations is rewarding Shell for the environmental and human rights disasters it
continues to create in Ogoniland and the Niger Delta. We feel the organisation has either
been misled or are in collusion with Shell and other corporate interest to "greenwash" the
image of Shell with this award. We are asking WEC to automatically disqualify Shell from
this award until such a time when Shell accepts full responsibility for the mess it has
created in Ogoniland and the Niger Delta.

"Please stand up against forces of imperialism such as Shell who prey
on the people, dehumanise them, break their dignity, destroy their sources of
livelihood and then flaunt their conquest with undeserved awards and obscene profits.

"Stand up for the oppressed people of the world whose lives are daily
traumatised by these gang of irresponsible multinational companies which pride themselves
on corporate greed, corporate deception and corporate thuggery.

"Protest this double injustice against the Ogoni people. Protest this
shameless act by Shell and its cohorts. Petition the blood of Ken Saro Wiwa and that of every
Ogoni child, who have been denied normal childhood and a healthy environment by Shell.
Please give the voiceless a voice, and support the Ogoni people by adding your name to
the petition.

"The signatures will be forwarded to WEC, United Nations offices and
Shell offices across the World as soon as possible.

We thank you for your untiring support for the rights and survival of
the Ogoni people. The
     Struggle continues,
     Mrs Gbenewa Phido
     MOSOP-UK President

Here's a model letter for organizations or individuals to send:

       John .F. Mizrock
       President /CEO
       World Environment Center (WEC)
       49 Park Avenue South
       Suite 1800
       New York NY 10016, USA

       Dear Mr Mizrock,

On 10th January 2001, your organisation (WEC) ignored Shell's
disgraceful environmental record and gave them an award for environmental quality.

We, the undersigned organisations and individuals from around the
world, wish to express our total disappointment and shock at your choice of
company - Shell whose environmental track record in Ogoniland and the
Niger Delta of Nigeria is below average to say the least. We share the concerns of
the  Ogoni people who have called for the immediate disqualification of Shell from this
award. This is because an environmental award to Shell undermines the struggles and
demands for a healthy environment by the Ogonis as well as exonerates and endorses
the company's atrocities in the community since 1958.

We understand that WEC is an independent organisation which has been
funded by the United Nations Environment programme to advance sustainable
development and social responsibility, encouraging environmental leadership
and help improve environmental health and safety practice world-wide.
Going by this criteria, giving this award to Shell confirms your
organisation's refusal to abide by its stated terms of reference thereby encouraging
the destruction of the natural environment of the Ogonis and Niger Delta
people whose land is continuously being savaged by Shell in Nigeria.

Shell's activities in Ogoni led to the community's crisis of 1993 -
1996, which resulted to the killing of over 3,000 people including women and children. Other
human rights violations that ensued included raping of thousands of teenage girls,
young women and grandmothers, the sacking of 30 Ogoni villages and the maiming of
youths etc. These human rights violations was climaxed with the hanging of human &
environmental rights activist Ken Saro Wiwa and 8 other Ogonis on November 10, 1995 which
caused international outrage on Nigeria and mass boycott of Shell's product
across the world.
The human and material cost of this crisis on the Ogoni people cannot
be quantified in monetary terms. Yet Shell's reckless oil exploration activities remain
unchanged in the Niger Delta. Shell's poisonous gas flares still pollute Ogoniland 24
hours daily since 1958, causing terminal lung and chest illnesses; surface pipelines still
criss-cross the lands, causing explosions from overheating; oil spills and fires continue to
destroy lands, streams and rivers. Shell still refuses to implement proper cleanup
activities on the land or offer compensatio to the landowners etc.

See below Shell's most recent disasters in the Niger Delta of Nigeria.

RECENT HISTORY ON SHELL'S ENVIRONMENTAL DISASTERS IN NIGER DELTA:
       1. "Pipeline explosion rocks Delta Community. This pipeline
belonging to SPDC exploded in Warri. Spilling about a million barrells of oil in
the area" - Daily Times of Nigeria 9th January 2001

Nigerian Guardian 25th December 1999.
       11. "6 Years after abandonement, Shell facilities spew oil in Bodo"
- ERA 27th December 1999
       12. "Shell in Bille; unending spills and crisis" - ERA 24th November
1999
       13. "Shell fails to clean spills, refuses to pay compensation in
Amuse Oyigbo" - ERA 22nd Nov. 1999
       14. "Shell's well in Ogoni area goes aflame. A dormant oil well
belonging to Shell burst into flames in Yorla oil field" - Nigerian Guardian 27th July 1999
       15. By 1993, Ogoni could point to 3,000 oil spills from
high-pressured oil lines laid over their farmlands.
       16. Shell has been summoned to the Human Rights Commission sitting
in Port Harcourt - Nigeria on 16th January 2001. This is in relation to the
corroboratory role it played with the Nigerian dictator by sponsoring the Nigerian army with amunitions
and financial assistance, which was used to kill, unarmed Ogonis in order to deter
them from protesting against its activities. Shell is also expected to answer to its role
in the hanging of Environmental /Human Rights Activist Ken Saro Wiwa and the 8 other
Ogonis hanged by the draconian regime of Sani Abacha. - Comet News 16th January 2001
       17. "Shell fights compensation order of $40m" - British Broadcasting
Corporation News 26th June 2000. Shell still refuses to pay oil spill compensation
court order to the Ebubu Ejaama people of Ogoni for 1970 spill, which devastated the area.

Judging from above, it is obvious that Shell's presence in the Niger
Delta of Nigeria does not reflect the environmentally friendly organisation that it portrays
to the International community. The true story of Shell in Nigeria is that of an
organisation that ignores social  responsibility, sustainable development, and exhibits great disdain
for environmental health and safety.

Finally, the award you contemplate suggest that you are rewarding
Shell for its cruel  disregard for the environmental and human rights of the Ogoni people
in particular and the people of the Niger Delta in general. This contemptuous award
defies the memory of  Ken Saro Wiwa and thousands of Ogonis who have laid down their lives
in protest of Shell's corporate cruelty and irresponsibility.

We are by this petition demanding that you immediately disqualify
Shell from this award until it changes it attitude towards the environmental and human
rights disasters in Ogoni and the Niger Delta.

     Yours truly,

     Signed by:
