At Wal-Mart, not only is there no such thing as a free lunch, allegedly, there's no lunch at all.

That's why Wal-Mart finds itself back in court - this time it's been accused of denying thousands of workers' lunch breaks that are required by law. The case covers 116,000 former and current Wal-Mart employees in California, who are owed more than $66 million in back-pay plus interest for unpaid work during lunch.

"Time theft" labor abuses are a chronic problem for Wal-Mart. In fact, the company has paid millions to settle numerous cases of this sort already, in which its employees were denied breaks required by law, forced to work off the clock, or denied overtime pay for hours worked.

As the world’s largest retailer and America’s largest private employer, Wal-Mart clearly has some explaining to do. But rather than address the serious issues raised in the worker discrimination lawsuit, Wal-Mart has aggressively fought the charges and attempted to keep this suit out of court for the past four years.

When will Wal-Mart learn that treating workers fairly doesn’t come at the expense of corporate profits? After all, workers who are treated with respect are more loyal to their employers and work harder too.

That's why we must use our power as consumers to be a catalyst for change. Tell Wal-Mart's management to take immediate steps to end these alleged workplace abuses!

 didn't make it into last summer's Bush-Cheney energy

 last year by fleecing us at 
 the gas pump. Now their cronies in Congress would

House Votes to Weaken the Endangered Species Act

bighorn sheepCongress took the first step last week toward gutting the 30-yearold Endangered Species Act, America's safety net for fish and wildlife at the edge of extinction, voting 229 to 193 for legislation crafted by House Resources Chairman Richard Pombo. If it becomes law, the bill will eliminate the requirement for "critical habitat" for endangered species and makethe government pay developers and polluters not to kill publicly owned fish and wildlife.

The landmark Endangered Species Act, signed into law three decades ago by President Nixon, has prevented 99 percent of all species ever placed under its care from becoming extinct and has helped foster the return of wildlife such as the bald eagle.

Pombo's dangerous bill can still be stopped in the U.S. Senate. Take action to tell your Senator that you support protection for endangered species such as the bighorn sheep, the American bald eagle and thegrizzly bear.

From the Front Lines on the Gulf Coast

Rose Johnson and Lark Mason observe hurricane damageMississippi Chapter Chair RoseJohnson, right with fellow Sierra Club volunteer Lark Mason, has 14 relatives staying at her tarp-covered home since Hurricane Katrina. She's spent the past three weeks volunteering in North Gulfport providing meals and other relief supplies. But the damage to homes in the low-income minority neighborhoods of North Gulfport didn't prepare her for the scene south of the tracks in Gulfport. The neighborhood was surrounded by razor wire to keep people out, and mounds of debris stood eight to ten feet tall, like broken shipping containers with pork and chicken products. "The stench was sobad you could taste it on your tongue," she said.

Paul Stewart, who's now living in Maryland because his home was destroyed, used to live across the bay from DuPont's DeLisle titanium dioxide plant and its waste pits containing dioxin and heavy metals. He doesn't believe DuPont's insistence that everything is safe. "Katrina did not pollute our land," he says. "DuPont did. By locating that plant directly on the bay in a hurricane prone area, DuPont played Russian roulette and lost, and our land is now toxic."

global warmingThe recent hurricanes put a new spin on climate change, eventhough climatologists are careful to clarify that no single hurricane can be blamed on global warming. Climatologists do agree, though, that global warming is real. So why does the media keep reporting that there's uncertainty about it?

In an interview with the Planet's Timothy Lesle this summer (before Katrina), Stanford University climatologist Steven Schneider explained that the "uncertainty" stems in part from how the media triesto cover science the same way it does politics, with a balance presentation of two sides. But in science, he says, "there aren't two sides."

A Big Win in Utah for Sensible Transit

sprawlIt's official: The evils of urban sprawl are not inevitable. Last month, Governor Jon Huntsman, the Utah Department of Transportation (UDOT), the Sierra Club, and Utahns for Better Transportation reached a win-win agreement on the Legacy Parkway project. The new agreement jump starts plansfor a new TRAX light rail or bus rapid transit in south Davis County. Contemporary parkway features will also reduce impacts to the wetlands of the Great Salt Lake through a narrower footprint, lower speeds, and less noise by prohibiting trucks and utilizing quiet, rubberized asphalt pavement. Thesettlement addresses transportation challenges, saves money, and enhances the environment.

Take Back Our Rivers

For six summers, starting in high school, Chad Pregracke, a master speaker at Sierra Summit, worked as a commercial shell diver, breathing through a jury-rigged apparatus eight hours a day in the darkness of the river bottom, pulling up 120 pounds of clams at a time.

During his time on the river, he noticed massive amounts of garbage -- tires, mattresses, Styrofoam, 55-gallon drums, trucks, vans, televisions, refrigerators, tractors. Pained to see the neglect of such an important and legendary river, he began to pick up the trash, and called Illinois legislators and the governor for help. To no avail.

But he convinced Alcoa, headquartered nearby in Davenport, Iowa, to give him an $8,400 grant; got some help from fisherman, hunters, and birdwatchers; and founded Living Lands and Waters, which today organizes river cleanups that restore hundreds of miles of the Mississippi, Illinois, Ohio, and other rivers.

In the name of "streamlining" our courts, the Senate is considering
stripping prisoners of their right to challenge wrongful convictions.
The Streamlined Procedures Act - S. 1088 - will leave state prisoners
with few legal remedies in federal courts when they're wrongfully
convicted.

would still be incarcerated.  People who lack the resources to
adequately defend themselves will be most affected by this
legislation.  S. 1088 sends a message that the government is more
interested in streamlining executions then ensuring justice for the
innocent.

A key decision is about to be made about whether or not our National Marine Sanctuaries will be able to protect important marine habitats and ecosystems within their boundaries.

Please take action right away and let the Administrator of the National Oceanic and Atmospheric Administration know our National Marine Sanctuaries must be able to protect our special ocean places and the marine life they contain.

When you look out over the open ocean you can picture the marine life teeming below the surface - sea turtles, whales, fish, vibrant corals, and lush kelp forests.  Sadly, however,  our living oceans are showing significant signs of declining health.  Human activities have resulted in habitat destruction, overfishing and loss of biodiversity, damaging ecosystems.

To help protect and manage many of the most special ortions of our ocean environment, some areas have been designated National Marine Sanctuaries.  Similar to our national parks and wildlife refuges, marine sanctuaries are supposed to protect, where necessary, and restore the living marine resources within their boundaries, while providing for public education and enjoyment.

But not all marine sanctuaries are created equal.  Many actually allow activities that harm the very ecosystems and marine life they are supposed to protect. These activities can include fishing.  You can help ensure that such areas are not just paper sanctuaries and ensure that these national treasures protect the marine ecosystem for future generations as intended.

The Channel Islands National Marine Sanctuary off the coast of California is the sanctuary most immediately impacted by this issue.  But the pending decision has implications for the entire National Marine Sanctuary Program's ability to protect ocean life and habitats, including those of the proposed Northwestern Western Hawaiian Islands Sanctuary.


The Channel Islands National Marine Sanctuary is nearing completion of a six-year process to establish fully protected marine reserves within its boundaries where fishing and the taking of marine life is prohibited.  At the last moment, a movement has developed to deny the Sanctuaries Program the authority to create these safety zones, on the grounds that protection of habitat and wildlife encroaches on the authority of fisheries management.  Whether fisheries management or Sanctuary protection will prevail within our nation’s marine sanctuaries is a critical decision that will be made shortly by the National Oceanographic and Atmospheric Administration. 

The Ocean Conservancy, other conservation organizations, and scientists believe that denying the Sanctuaries the right to establish areas protected from fishing would represent a major setback to recent gains in marine ecosystem-based management. 

You can help take action by sending a letter to Admiral Lautenbacher, Administrator of the National Oceanic and Atmospheric Administration.  Admiral Lautenbacher will be making this important decision by mid-October so please take action today.

More Information on The Channel Islands:

In October 2002, the California Department of Fish and Game, working in partnership with the Channel Islands National Marine Sanctuary (CINMS), designated 12 MPAs (10 no-take marine reserves and 2 marine conservation areas) in state waters within the Sanctuary. 

The process of formulating the reserve designations involved years of meetings by a multi-stakeholder Marine Reserve Working Group supported by a Science Advisory and Socioeconomic Advisory Panel, culminating in recommendations adopted by the Commission.  The federal component of the reserve was to be completed by complimentary action by the Sanctuary extending these MPAs into federal waters through the selection of the reserve areas recommended by the stakeholder process.  These areas were to be listed as the preferred alternative for the sanctuary designation pursuant to the National Environmental Policy Act (NEPA) and the Sanctuaries Act in consultation with the PFMC. 

The Sanctuary process requires a change to the CINMS designation document in order to establish regulations that affect fishing, since fishing is not presently subject to regulation by the Sanctuary. Allowing a Marine Sanctuary to make rules that affect fishing is opposed by some agencies that manage fisheries as an encroachment on their “turf.”  We need your help to ensure that federal “turf” battles do not prevent Sanctuaries from stopping the killing of fish and other marine life.  Sanctuaries are special ocean places and need the special protection afforded under the Sanctuary Act.

supported Roadless Area Conservation Rule, opening nearly
sixty-million acres of America's last wild National Forests 
to logging, road construction, mining, oil exploration, and other
forms of development. 

Under the new policy, if governors wish to have
roadless areas within their state protected, they must complete a
burdensome petition process and file their recommendations with
political appointees at the Department of Agriculture. The
federal government is free to accept, modify or reject these
petitions, while elected officials and citizens outside those
states will have no say at all about the fate of these shared
national treasures.

Conservationists throughout the country are joining
together to file an official petition with the Bush
administration to demand the reinstatement of the 2001 rule. We believe that:

America's last roadless National Forests belong to
each and every American and all our remaining roadless areas
should be protected, completely and permanently through
reinstatement of the Roadless Area Conservation Rule of 2001.

Did you know the food industry is busy lobbying Congress to change the law so that artificial ingredients can be included in foods labeled "organic"?

As the primary shopper in my household, I've got enough to worry about without having to question the authenticity of the food labels I read at the grocery store.

But big food manufacturers such as Kraft are lobbying Congress to change the law so that artificial ingredients can be included in foods labeled "100% organic." Tell Congress not to weaken this law!

Why can't they just leave well enough alone? In a word - profit. Food companies know that educated consumers care about the foods they eat and are willing to pay more for healthy products that carry the "organic" label.

Most shockingly, the industry is claiming that consumers do not care about the use of artificial ingredients in food products labeled "organic" and are trying to slip this change into the law without any public input whatsoever.

But of course consumers like us do care! A recent nationwide survey by the nonpartisan watchdog group Consumers Union found that an overwhelming 85% of Americans said they do not expect food labeled as "organic" to contain artificial ingredients.

Now, we must make sure that the our voice is heard - and not simply that of big business. But we must act quickly - the issue is being considered in Congress this month!

Tell Congress that consumers want "organic" to mean exactly that - no artificial ingredients!

As a result, many Red Knots are now unable to gain enough weight to successfully complete their 15,000 mile migration to the Arctic and arrive fit enough to produce offspring.

Over the past decade, Red Knot numbers in Delaware Bay have declined from more than 100,000 to only around 17,000. If state and federal government officials don’t act soon, this population of knots faces an imminent risk of extinction, possibly as soon as 2010.

As a member of the Atlantic States Marine Fisheries Commission, your state can support an action that would help prevent the Red Knot’s extinction - a moratorium on the harvest of the Delaware Bay population of horseshoe crabs.

Sadly, these magnificent animals are being threatened on a variety of fronts. They're being poached for their pelts or believed medicinal value, and exposed to diseases from domesticated species. Habitat loss through development and unsustainable resource exploitation is adding further pressure and causing a rapid decline in their numbers.

That's why several concerned members of Congress have introduced the Great Cats and Rare Canids Act (HR 1707). The Act would provide crucial funding to save thirteen highly endangered feline and canine species across the globe, estimated at a mere $5 million per year.

If we act quickly and decisively, we can dramatically improve the long-term prospects for survival of these big cats and rare canines in the wild. I think we all can agree that we owe it to future generations to protect these beautiful and biologically important animals.
